These Terms of Service ("Terms") govern your access to and use of EcoAssess and any other application in the BioGeo App Suite (each an "App"), and the associated websites at biogeo.com.au and ecoassess.biogeo.com.au (together, the "Service"), provided by BioGeo ("BioGeo", "we", "us"). By creating an account, starting a trial, or using the Service, you agree to these Terms. If you are agreeing on behalf of an organisation, you confirm you have authority to bind that organisation.
EcoAssess is a desktop application that lets you define a study area and query it against spatial data layers sourced live from Australian government agencies and other authoritative or open data providers, and generate summary reports. The Service is currently available for Queensland only, with additional states planned for future release. Features, coverage and data layers may change, be added, or be withdrawn at any time as the Service develops.
You must provide accurate registration information and keep your account credentials confidential. Accounts are for use by the named individual (Solo plan) or by up to the named number of users under your organisation's plan (Team or Firm) — accounts and login credentials may not be shared beyond your plan's permitted user count.
Where a free trial is offered, it runs for the period stated at signup. A valid payment method is required to start a trial. If you do not cancel before the trial ends, your subscription begins automatically at the plan and billing interval you selected, and your payment method will be charged.
Subscriptions are billed in advance on a monthly or annual basis via our payment processor, Stripe. By subscribing you authorise us to charge your payment method on a recurring basis until you cancel.

You retain ownership of the study areas, project details and other information you input into the Service ("Your Content"). You grant BioGeo a licence to process Your Content solely to operate and improve the Service, including to run your queries and generate your reports.
Reports, exports and other outputs generated for your account are yours to use, including for internal purposes, client deliverables, and lodgement with regulators, subject to the accuracy limitations in Section 6. Underlying government and third-party data displayed within a report remains subject to the terms of its original source — see our Data Sources & Licensing page.
BioGeo and its licensors own all rights in the Service itself — the software, design, branding and underlying platform — excluding Your Content and third-party source data.
EcoAssess is a preliminary desktop screening tool. It aggregates and queries data published by third parties, including Australian, state and Commonwealth government agencies and open-data providers. We do not control, verify, or guarantee the accuracy, completeness, currency or fitness for purpose of that underlying data.
Results, reports and any statement generated by the Service are indicative only. They are not a substitute for a site visit, a qualified ecologist's independent assessment, or advice from a suitably qualified professional or lawyer, and must be independently verified against the relevant data custodian before being relied upon for any statutory decision, referral, development application, environmental impact statement or other regulatory or legal purpose. The absence of a recorded constraint in EcoAssess does not confirm the absence of that constraint on the ground.
To the maximum extent permitted by law, the Service is provided "as is" and "as available", without warranties of any kind, whether express or implied, including any implied warranty of merchantability, fitness for a particular purpose, or non-infringement. Nothing in these Terms excludes, restricts or modifies any consumer guarantee under the Australian Consumer Law that cannot lawfully be excluded.
To the maximum extent permitted by law, BioGeo will not be liable for any indirect, incidental, special, consequential or exemplary loss or damage, or for any loss of profits, revenue, data, goodwill or business opportunity, arising out of or in connection with your use of, or inability to use, the Service — including any loss arising from reliance on a report or result generated by the Service.
To the maximum extent permitted by law, BioGeo's total aggregate liability arising out of or in connection with the Service, however arising, is limited to the amount you paid us for the Service in the 12 months preceding the event giving rise to the claim. Where a condition or warranty cannot lawfully be excluded under the Australian Consumer Law, our liability is limited, at our option, to re-supplying the Service or the cost of having the Service re-supplied.
The Service queries and displays data from third-party government agencies and open-data providers (see our Data Sources & Licensing page), and relies on third-party infrastructure providers including Stripe (payments) and Supabase (authentication and account data). We are not responsible for the availability, accuracy or conduct of these third parties, and your use of data they provide may be subject to their own separate terms.
You may stop using the Service and cancel your subscription at any time as described in Section 3. We may suspend or terminate your access if you materially breach these Terms, including the acceptable use provisions in Section 4, or if we reasonably believe your account has been compromised or is being used fraudulently. On termination, your right to access the Service ends, but Sections 5 (as to reports already generated), 6, 7 and 10 survive.
These Terms are governed by the laws of Queensland, Australia, and you submit to the non-exclusive jurisdiction of its courts.
We may update these Terms from time to time, for example as the Service or its data sources change. We will update the "Last updated" date above, and where a change is material we will make reasonable efforts to notify active subscribers (such as by email or an in-app notice) before it takes effect. Continued use of the Service after a change takes effect constitutes acceptance of the updated Terms.
